    本研究は，人口減少社会において多様性のある地域生活を再生するための新たな視点として，①住民サービスのネットワーク化，②緑の公共事業，③公共施設のリスク管理を提示している。また，研究方法として，国内外の地域研究を重視し，仮説を検証・進化して新しい生活基盤整備法政策を構築しようとするものである。本研究には多面的分析が必要なため，①ネットワーク研究，②公共事業研究，③リスク管理研究を目的とする3つの研究班を作る。また，各班に，国内の地域研究を中心に行う者と理論研究を中心に行う者を配置し，各班で両研究の交流を図れるように組織する。さらに，各班の研究成果をメンバー全員が共有し，各研究を有機的に結びつけるため，全体研究会を開催する。本研究では，研究期間4ヶ年をおおよそ3つの段階に分け，本研究を進める。
    初年度にあたる今年度は，これまでの日本の法政策のどこに支障があり何が足りないかを明らかにした上，本研究が提示する3つの視点が，従来の法政策に代替しうる新たな法政策の基盤となりうるかどうかの検証を行う第1段階の研究を中心に行った。具体的には，第1に、年度当初に第1回目の全体会合を開催し，本研究の目的・研究計画について確認した上，メンバーを3つの班に組織し，今後の計画について意見交換を行った。第2に，2019年秋に開催された日本公法学会総会において、山下が「縮小する社会における持続可能性法理の可能性と限界」というテーマで報告を行い，政府が進めている人口減少政策の構造を整理し，持続可能性法理の可能性と限界について検討を行った。第3に，年度終わりに第2回全体会合を開催し，研究分担者から「所有者不明土地問題の背後にあるアンチ・コモンズ問題」というテーマで報告していただき，2020年度に向けての研究計画について意見交換を行った。

    本研究は人口減少が土地収用制度にもたらす諸課題について，東アジア４法域（日本・韓国・台湾・中国）の比較法的考察を行うことを目的とし、特に(1)「私益収用」における「公共の利益」の問題と(2)共同体との関係における生活再建措置を中心とした「損失補償」に焦点を当てて比較するものである。
    9月には、研究成果の一部を、金子由芳教授(神戸大学）、Brian Z.Tamanaha教授（ワシントン大学セントルイス校教授）と共同で編集した Yuka Kaneko/Narufumi Kadomatsu/Brian Z. Tamanaha, Land Law and Disputes in Asia:In Search of an Alternative for Development(Routledge,2021.9)（https://doi.org/10.4324/9781003170600)で公表した（第2部（Land taking for "development" and beyond)(第5章（角松）、第6章（兪／ソ）、第7章（李）、第8章（矯／楊）)及び同書第3部第9章（高村）、第12章(松本））。。開発法学の視点からアジア諸国における所有権と土地紛争を分析する同書第1部・第4部、コモンズ論との関係に着目して分析する第3部と並べることで、本研究の成果をより広い文脈に位置づけて国際的に発信することができたと考えている。また10月には神戸大学社会システムイノベーションセンターとの共催で、同書に係るBook Launching Seminarを行った。
    加えて、2019年11月に行った韓国現地調査の成果について、既に上記図書第6章を公表しているが、髙希麗「韓国・済州道における土地収用 : 西帰浦市イェレ洞リゾート型住居団地訴訟を事例として」神戸法学雑誌71巻4号を公表した。

    気候危機をもたらした原因は、自然に対する人間の関係の変化のうちにある。この関係行為を、所有として捉えたK.マルクスは、私的所有に基づく資本主義的生産・流通・消費のメカニズムのうちに、人類と自然との物質代謝を攪乱する構造的要因があることを論じていた。このマルクスの省察に立ち返って、持続可能社会への転換を所有論の視角から考察する研究に従事した。持続可能社会に適合的な所有の在り方への転換を、マルクスが資本論で展望した「個体的所有の再建」論の脈絡の中で考え、「個体的社会的所有」として概念化することを試みた。実定法上の農地所有権（農地法上の個体的権利規定と、農業経営基盤強化促進法上の農地の集団的自主管理制度）は、この概念に親和的である。
    他方上記の理論研究とは別に、特に条件不利地域である里地里山、山林での農林地の持続的維持管理の社会の取り組みを調査を通じて把握することに努めた。原発の事故の影響を直接被った二本松市東和地区では、「ゆうきの里東和ふるさとづくり協議会」が多様な活動を通じて、地域資源循環型のふるさとづくりを目指している。一つの成功例だが、その一つの要因は、中山間地域直接支払制度、多面的機能支払制度の交付金、指定棚田地域認定等の、国の支援制度を有効に活用している点が挙げられよう。
    また田村市の市民の任意団体である「あぶくま山の暮らし研究所」が、放射能の影響で壊滅的な影響を被ったシイタケ原木生産の代わりに、百年の森づくりを展望して、①生物多様性や景観を含む文化的価値の再評価の必要、②山に限定せず、田畑や宅地を含めた地域資源管理の在り方の検討、③地域資源管理の責任を森林所有者に押し付けず、山に根差して暮らす地域の生活者も当事者として、地域資源管理のあり方を検討、④住民が地域資源管理のあり方を提示し、必要な経費を東電と国に求める、といった活動をしていることが注目される。

    As a result of micro-data analysis of the 2000 Census and national survey of customary forest 1974, we found that the impact of registered ownership on forest management has increased over time, and that the existence of multiple co-owners who do not lose their rights even if they leave the village makes it difficult for the remaining villagers to make collective decisions. The results will be published as a refereed paper in the International Journal of the Commons and as a Ritsumeikan Policy Science discussion paper online.

    Using a large quantity of historical documents about the forest commons, we carried out a empirical study and a theoretical study about the mutual linkage of the change of the social economic environment and the institutional change. As one of empirical studies in Iwate of the Meiji period, we examined the difference of collective action between an independent group and plural groups. The result shows that the establishment of the rule about the usage of resources is easy to be carried out in plural groups more more than an independent group.

    The legal status of non-profit organizations in various aspects of participation, information access and collective litigation was ascertained in a unified manner according to the types of interests.
    In particular, regarding group actions, reference was made to consumer group actions, while comparisons were made between French, German, English and US group actions. As a result, it was concluded that, although it is realistic in Japan to introduce an environmental group lawsuit based on prior approval, it should diversify according to the difference between the general public interest type and the common interest type.
    On the other hand, in order to elucidate the legal relationship between the administrative and non-profit organizations, emphasis should be placed on legal order formation through administrative contracts and administrative plans. The assumption is clear that it should work.

    This study is interdisciplinary research for asbestos disaster and its measure as to prevention, compensation and relief in the world with international relations as a key point.
    As world survey, we investigated asbestos mining production countries (Canada, Russia and Italy), asbestos use country (Thailand) and asbestos countermeasure promotion countries (the United States and the United Kingdom). As a domestic survey, we discussed the current situation of local government action and asbestos victims’ relief system. We clarified an academic prospect of stock (long-term) type disaster study. We released research outcomes as to Japan’s experience of asbestos disaster several times in English.

    This study treats the problems of hazardous disaster waste and public policy for disaster area recovery.
    As a historical survey, we investigated actual conditions in the damaged area of the Great Hanshin-Awaji Earthquake in 1995 by the questionnaire to the residents, document research and so on. Concerning the Great East Japan Earthquake in 2011 and the Kumamoto earthquake in 2016, we clarified the data of disaster waste and its management problems based on our field study and the questionnaire to local governments in Japan. Finally, we examined a prospect of policy science as to hazardous disaster waste management for disaster prevention and damaged area recovery.

    The unoccupied house problem is an urgent policy issue in Japan. While municipal ordinances and the Unoccupied House Law mainly aim at eliminating negative externalities to the neighborhood, a policy-oriented and strategic perspective is indispensable in order to cope with this issue.
    This research project organized a group consisting of researchers of public law, private law and sociology of law. It conducted a literature survey and field survey on Germany, France and the United States on the issue and held an international symposium to make the results public.

    We have engaged in research of medical malpractice litigation and the way of regulate medical research in Japan and in other countries. We went to the U.S., Unitied Kingdom, France, Germany, Australia, and Korea to research the way to introduce expertise in civil ligitagion which have some scientific or medical issues. Esepcially, we focused on "concurrent evidence" in the NSW of Australia and consider the application of that king of expert evidence and made some proposals of introducing new procedure of expert evidence in which two or more experts serve as expert witness or court-appointed experts concurrently.We tried to publish the result and proposal on not only on journal but at various kind of conferences including international academic meetings.

    This study aims to consider the reasons of sustainability of suburbs in the case of eastern shore areas of Lake Biwa from the comprehensive viewpoint of spatial and social aspects based on the comparative analyses between the well-balanced area of age and the average areas. Findings are as follows: Firstly, surplus farm land in the well-balanced area of age could be changed for residential use and detached houses near farmers area, and as a result, more families started living in this area. Secondly, workers in the well-balanced area of age are commuting to neighboring districts and, at the same time, to farther places out of the city. As a result, the time for commuting becomes longer in the well-balanced area than in average areas.

Secondly, we have constructed the professional network on asbestos and related issues through our research action, the presentations at a conference, and international academic conference. Finally, we send out our research results to Japan and the world through the publication of academic journals and English book.

    The "community autonomy" in this research means a system usually called inner-municipal decentralization, in which first an area of a city(which has become too large to make democracy work well) should be divided into several parts(wards), second a branch of the local government or a community center should be established in each ward and third a representative organ of the residents should be organized in each ward. This kind of system is found in many countries in the world. In Japan as many local governments of municipalities have planned and promoted "community policy" since 1960s, various programs that can be seen as a kind of inner municipal decentralization have been implemented. In this research we focused on the characteristic features of Japanese systems of community autonomy, taking into account the knowledge we collected from many countries such as Germany, France, England, Scotland, United States of America, China, Korea, the Philippines, India and so on. Through these works of international comparison as well as the fieldworks in many cities in Japan we tried to identify the items which are essential to characterize the "community autonomy" system of cities. This research should be a important preparing work to build a database on the inner-municipal decentralization.

    This research project has focused on characteristic aspects of recent inner-municipal decentralization systems in Japan in comparison to those in different countries. The amendment of the Local Government Act 2004 has estabilished a legally organized inner-municipal decentralization system for the first time in Japan, with the result not only that there are some municipalities which use this legal system as a tool for community policy, but also that municipalities which hesitate to use it but are eager to promote local community have developed their own systems (in some cases by a by-law). We studied different inner-municipal decentralization systems in five different countries (i.e. Germany, France, Scotland, US America and the Philipines) with the method of field work, comparing them with one another and with the systems in Japan.
    Confronted with the protracted recession and the great deficit of both national and local finance many countries adopt nowadays under the motto of“coproduction"or“cooperation"the policy of activating civil society, namely the policy to make citizens do more for public services for themselves and to reduce financial spending. The function of the inner-municipal decentralization system should be changed to work adequately for this purpose. But in the European countries the system is originally designed not for activating the capacity of civil society to perform public tasks, but to make the process of public decision making more democratic, and therefore the policy is not successful. On the other hand the system in Japan is from the beginning on designed for promoting the cooperation and is to some extent successful in this sense.

    The system of "neighborhood government" or "intra-municipal decentralisation" have interested academic as well as practical world in Japan since several years. This project intends to research the systems of United Kingdom, United States of America, Germany and France in comparison with the system in Japan. I has paid special attention to the "basic local organizations", which we think are necessary to male the system work well. In Japan the basic local organization in this sense ist narurally the "Chonaikai" or "Jichikai". We visited together cities Setagata, Takarazuka, Kitakyushu and Kobe to see how tie system of intra-municipal decentralisatiton work on the bass of this kind of specifically Japanese local organization. The clear relation between the system and the local organization however cannot be found in other countries except Germany, where the intra-municipal decentralisatiton has been organized on the basis of political parties for a long time But on the other hand we found the situation which the hypothesis or starting point of the project makes sense if the concept of "basic local organization" is extended to the different actors who are active in the community-level, namely the sisuation of "collaboration". The trend of the so-called "collaboration" is found in ail doe countries and many different kinds of non-profit organizations function there as actors of collaboration. During in the classical system of intra-municipal decentralisatiton (for example in the system of German "kommunale Untergliederung" or the English `local council") the essential aim of the system consists in the democratisatiorn of the public decision making in the age of gigantic municipalities, the important point of the system today consists in the problem of public service in the age of neo-liberalistic reform, a problem which the countries want to save by means of mobilizing the different powers of civic sectors.
