    　View Summary

    This research analyzed how the practice of “positive complementarity” of the international criminal tribunals, which aims to build domestic capacity for addressing war crime issues, have been contributing to building the domestic rule of law. This research showed the contributions of the international criminal tribunals for building both aspects of broad-sense of the rule of law, which means value codes denying the legitimacy of war crimes, and narrow-sense of the rule of law, which means specific rules and organs support applying them, by taking advantage of their expertise. However, this does not mean that the tribunals can make up for every part of the domestic rule of law, as it can be observed in the lack of reparative mechanisms for victims. This research concluded that the role of other justice mechanisms is required for compensating the lack of functions of the international criminal tribunals.
