    This study aims to analyze current issues, as well as extract issues, on food safety legislation in Japan, China, and Korea under close cooperation among research organizations in each country. The researchers further aim to make policy recommendations on food safety legislation in their own countries.
    For the purpose mentioned above, a 3-year project was organized with a research group including researchers and practitioners who have specialized knowledge of administrative law, consumer protection law, and criminal law in the three countries of Japan, China, and Korea. During the research period, a total of 12 international research conferences or symposia were held.
    As a result of the research cooperation, common experiences and issues have been shared among Japan, China, and Korea, and the conclusion of the project has been published as “Food Safety Legislation and Citizen Safety and Security” (TAKAHASHI Shigeru(ed.), Daiichi Hoki, 2019).

    Legal problems with the progress of the technology, such as the risk management of the atomic energy technology, the problems of the advanced medical study and the information protection with the advancement of the information and communication technology, are frequent today. Sporadic examination in every existing field of law cannat solve these problems. This study showed a comprehensive system design about the scientific uncertainty by the cooperation of law researchers and STS (Science, technology and society) researchers. Furthermore, this study showed the basic theory about legal rules of the technology, legal rules of the promotion of the technology and the restraint on the technology, the legal solution of the individual problems with the application of the technology (environment, medical care and suit system), and so on.

    Among many social and economical problems occurred by the Fukushima nuclear plant accident on March 11th 2011, the objects in this study are as follows; (1)information sharing the situation and problem of the claim of damages by victims, (2)Rearranging of issues and problems about liability, standard and scope of compensation, (3)Clarification of policy issues for the substantial remedy of victims, (4)Policy proposal for the creative recovery of victims and restore of disaster area and (5)Study of the process to develop from the remedy to the creative recovery and restore. As a result of this study, we clarified the approach to recognize actual problems, summary of issues for study objects of described above and proposed the solution to problems and policy frameworks of compensation for nuclear damages, process of decontaminating radioactive substance and so on.

    Strategies to reduce the damages by disasters are envisaged in the direction to strengthen disaster local resilience. It is a challenge to build a legal system on disaster prevention organization. In response to the phase and the cycle of disaster, "mitigation → preparation → response → recovery → mitigation →… " , to reduce the damage immediately after the disaster, an autonomous separated activities of communities are important. Community disaster prevention plan should ensure this autonomous activity of the communities. And it is essential to build the residents organization and train them. Following this phase, the response by collaboration and cooperation between municipalities, prefectures and nation are important. Cooperated responses are possible only after these sectors have common unified codes of command, standards and organization like Incident Command System of United States.

    In this study, as way of administrative response to the field that deals with the scientific uncertainty, we paid attention to a mechanism ‘Adaptive Management’ that adapt to it and analyzed the way to incorporate the structure into legal system design while continuously captured the improvement of professional expertise. To be more precise, we aimed at the safety regulations of the food and material, safety management of urban facilities and science facilities then learned from the knowledge of the safety engineering as source of these ideas and generated concepts of new legal structure design in the respective fields based on the actual practical operations and the latest trends in overseas. We think that we successfully proposed some of the concrete ideas to make the proposal possible by showing the need to incorporate the dynamics to correspond the progress in the legal structure that pursue security.

    In this study, I examined the way of the border setting with social risk that should be managed and the management in the pharmaceutical administration that is a typical model of risk management as a part of the studies on legal control of risks. And this study suggested the regulatory systems that there should be in the future including the Drugs, Cosmetics and Medical Instruments Act revision of Japan through comparison with EU and Germany legislation.

    The limit of "Public assistance" that was able to be put in a time of disaster recognized the disaster prevention power of the regional society again. On the other hand, the fear of the retreat of the public assistance is caused in shape of slimming down of the administration under this pretext. In this present study, the range that the public assistance, the mutual assistance, and each self-help had to accomplish originally was clarified, and, in addition, the relations between these were clarified. Moreover, the proposal assumed to have to install regulations that had to become grounds of the legal grounds regulations and support because a legal location was not necessarily clarified of the subject that bore the disaster prevention power in the region was done.

    本研究では、雲仙普賢岳噴火災害・北海道南西沖地震災害における被災者救済措置の一部を実態調査し、分析を行った。今年度は、前記災害の際の義援金配分をめぐる法的関係および被災者にたいする救援・生活再建対策について分析した。その結果、義援金をめぐる法律関係は公私にわたる多数の団体がかかわるためその法関係が複雑であるとともに、紛争を解決するための手続が非常に未整備であること、また、被災者の救援・生活再建については、ごく一部の分析にととめざるをえなかったが、被災者の権利保障の観点から今後の検討が必要であり、それに伴う法整備が不可欠になっていることが明確となった。カリフォルニア州の被災者救援・支援法制について資料の収集を実施したが、同州および米国においても法的観点からの分析・検討がきわめて少なく、議会資料や裁判例および各種報告書等を収集せざるをえず、いまだ中途の段階であり、さらに今後も収集・分析を要する
