    Abstract

    The digital economy continues to evolve in Japan and around the world. Big data and personal information have significant economic value and require appropriate legal protection for both information providers and users. Digital platforms, as online intermediaries, occupy a particularly important position in relation to the handling of such information. While digital platforms can greatly benefit society by accumulating and structuring large amounts of data from diverse markets, they can also be prone to the lock-in effect, resulting in monopolies or oligopolies due to network effects. Therefore, digital platforms can have a detrimental effect on individuals and society if they do not operate appropriately. Potential issues include a lack of transparency and fairness of transactions, distribution of infringing content, and the mishandling of data and personal information. Policymakers across the globe recognize these issues, and various regulatory measures have been proposed and implemented. In this paper, we outline how Japan regulates issues related to digital platforms and the digital economy, and highlight some nuances of the Japanese law by comparing it with corresponding European systems.

    Abstract

    This article provides an overview and discussion of a multitude of issues that are relevant for IP licensing under Japanese law. The authors recap the results of the legislative process that predominantly addressed the IP licensee’s position in the case of a licensor's insolvency, including the 2020 amendment to the Japanese Copyright Act, and examine whether a comprehensive reform of IP licensing regulations in Japan would be preferable to also offering better protection to trademarks, trade secrets and data licensees. Given that Japanese companies often agree on jointly owning IP generated in the process of software development and other co-development projects, we analyze the risks of joint ownership compared to non-exclusive licenses. To further illustrate such risks that may be even more significant in cross-border constellations, we conduct a comparative study on the actions that a party commissioning the development of new software can take without obtaining the software developer’s consent under Japanese, US and German patent and copyright law. Furthermore, we examine certain unresolved issues that may arise in the case of a party’s insolvency or the impact of force majeure events, and provide suggestions on how to address these when drafting and negotiating IP license agreements.

    研究期間の3年目に入り、研究を一層深化させるとともに、国内外の研究会、学会等で研究成果の発信を行った。具体的には、次のとおりである。(1)米国、ドイツ、英国、スイス等の研究者と実施した特許権侵害に対する救済措置に関する国際共同研究の成果をケンブリッジ大学出版から書籍("Patent Remedies and Complex Products: Toward a Global Consensus")として公刊した(オープンアクセスも可能な形で提供している。)。(2)特許制度の研究のためには、同様の保護対象を持つ営業秘密制度についても研究を行う必要があるとの認識から、営業秘密の国際的保護に関する研究を進めた。その成果を欧州の国際会議において、欧米の研究者と共通論題に関するパネルを組んで、パネリストとして報告を行ったのか、名古屋大学での国際会議等でも発表した(なお、2020年3月に、欧米の研究者も招いて国内で研究会を開催することを企画していたが、これは新型コロナウイルス感染症問題により中止した。)。(3)特許権の国際的保護に関し、実体法的側面と手続法的側面(国際私法の視点)の両方について研究を進め、成果を国際会議で発表した。経済学の観点からの研究としては、グレースピリオドに焦点を当てた研究を行い、国際会議で報告した。(4)標準必須特許を巡る問題につき、国内学会(法と経済学会)で報告するとともに外国研究者との共著書を出版した。(5)特許制度について考察する基礎として情報・データの法的保護に関する研究も行い、論文と研究会での研究報告を通じて成果を発表した。多数の国際会議での報告と、複数の書籍及び論文の発表を行い、また新たな研究者とのネットワークの拡大も実現できた。2020年度は最終年度の2021年度に向けて研究のとりまとめに着手する。2019年度も、個別テーマの探求が主たる活動となったことから、2020年度は特許制度全体に関する体系的な検討を進めることとする

    本年度も申請書記載のように、法学チーム、デザイン学チーム、実験チームの3チームでそれぞれ研究を遂行した。法学チームは、特に令和元年に改正された日本の意匠法について、その改正内容の検討を行なった。また、令和2年に公表された意匠審査基準((案)も含む)から改正の具体的運用についての検討を行なった。さらに、個別テーマとして、これまでの意匠法改正および令和元年意匠法改正における比較法の用いられ方について検討を行い、日本工業所有権法学会のシンポジウムで発表した。そして、令和元年改正により意匠法に新たな保護対象が追加されたことに伴う意匠の類否判断の際の需要者の把握について欧州との比較検討を行った。当該成果は来年度公表される。デザイン学チームは各国での創作実態と保護ニーズの分析を行い、さらに令和元年意匠法改正についてデザイナーから見た改正の評価の検討を行なった。実験チームはすでに終えた実験データを整理し、認知科学的類似概念から見た意匠の法的な類似概念(特に物品の意匠の類似に物品の類似が要求されることの是非)について法学チームとともに検討した。また、昨年度出版を予定していたが、日本の意匠法改正および意匠審査基準の内容を反映させる必要があることから出版を延期していた『Japanese Design Law and Practice』(Kluwer Law International社)について、改正内容等を各執筆者が反映させる作業を行なった。さらに、編集者が集まり、形式面の統一などの編集作業を行なった。令和元年に日本の意匠法が改正され、令和2年に改正法を受けた意匠審査基準が公表されたため、特に意匠審査基準について充分な検討ができなかったことによる。本年度は研究のとりまとめに注力する。特に、日本の意匠法改正により出版を延期していた『Japanese Design Law and Practice』(Kluwer Law International社)を公刊する

    I wrote a number of articles and book chapters and gave a number of lectures and presentations on the appropriate scope of patent protection, focusing both on appropriate enforcement procedures as well as on limitations and related procedure. Highlights were my contributions to the METI working group trying to establish a dispute resolution mechanism for standard-essential patents in Japan in 2017 and early 2018, and my conference presentation at the 1st World Conference on Access to Medical Products and International Laws for Trade and Health in Delhi in 2017

    The PI  purchased relevant books and studied recent Japanese and US cases that had an impact on developing patent disclosure guidelines. The PI also employed an RA to help in accessing and summarizing material, including technology details, in Japanese language. Research outcomes including an accepted paper at IPSC, and an invitation to conduct further research in this field at the CeBIL at the University of Copenhagen, the applications for which were prepared with help from the .特定課題 funding.. 

  • Enforcement of Patents in Japan, Germany and the US

    I received the Grant for Special Projects, and used it for arranging and attending a meeting with my cooperation partners in July 2012. The meeting and workshop was held in Seattle, USA. I specifically met with Professor Toshiko Takenaka and Dr. Jan Krauss, who are my co-authors of the treatise "Enforcement of Patents in the US, Germany and Japan", and with whom I intensively discussed recent developments and general differences under US and German patent law, the findings of which we reflected in our treatise preparation. During the same workshop, I also had the chance to meet with Mr. Mike Elmer, a senior attorney with the leading US IP law firm Finnegan, who is acting as a consultant for our treatise project. Mr. Elmer is running a global patent law database, in the course of which he and is collaborators are collecting and analyzing patent infringement litigation data from all major patent law jurisdictions worldwide. As we are planning to include some of Mr. Elmer's data into our treatise to provide the reader with a more complete picture of the statistical merits of patent litigation in each of the three jurisdictions we are examining (US, Germany, Japan), it was very helpful to gain further understanding of his findings and methodology. In addition, I had the chance to meet with our leading US attorneys during the workshop, who confirmed some of my understanding about current trends in US patent litigation, in particular with respect to parallel proceedings at US District Court and at the US International Trade Commission, which were essential for me in preparing a public seminar held in March 2012, and for preparing the respective parts of our treatise.
