ASANO Toyomi is a professor of history of Japanese politics at the Faculty of Political science and Economics, Waseda university. His areas of research are international and regional history in East Asia, which he argues on ‘legal and political’ analysis derived from the decolonization of Japanese Imperial order under American hegemony under so called Cold War situations. He graduated from doctoral course of the Graduate school of Advanced Social and International Studies in Tokyo University in 1998, affiliated as a research associate with Asia-Pacific Research Center of Waseda University 1998-2000, inaugurated to be a professor in Chukyo University from 2000 until 2014, receiving Ph.D. from Tokyo University in 2009. He had also been affiliated with Graduate School of Arts and Sciences of Harvard University as a visiting fellow 1994- 1995, Modern Chinese History research Center in Academica Sinica in Taiwan 1999, Sigur Center in Elliot School of George Washington University 2006-2007, Asiatic Research Center in Korea University 2009 as a visiting scholar. He won the 25th Masayoshi Ohira Memorial Prize in June 2009 and the Yoshida Shigeru Prize in March 2009 as an author of ‘Teikoku Nihon-no Shokuminchi Housei (Japanese Empire in the Nation State System by Legal Analysis),’ from Nagoya University Press 2008. He had worked both in Foundation of Japan-Taiwan Exchange Center 1995-1996 as a program officer of history exchange project, and in Asia-Women’s foundation as a working group member 1996-1999 for elucidating the historical facts.

    公文書自体の中に、朝鮮人差別の法的構造を示すものが存在しているが、他方でその差別に向き合おうとした官僚の苦悩も示されている。
    公文書の展示や利用については、歴史がいかなる社会的機能をしているのかを意識した上で、活用されるべきである。
    率直に言って、歴史は国内外の政治の中で、あるときは、政権の支持に利用され、またあるときには、反政府や人権のシンボルとなる。
    政治に組み込まれざるを得ない運命を歴史が持っていることを認識した上でこそ、現代人の感情や信念の代弁ではない、深い対話と、それを通じた、社会の相互進化・変容（無意識の内に、気づいたらお互いに変わっていたことを見出すような状態）に向けて、歴史が活用できるであろう。
    見たいものを見るだけの次元ではない、深い次元へ、公文書を中心とするデジタル資料の活用のあり方を高めていく必要がある。

    日韓関係を悪化させたのは、かつて政治家や研究者が有していた市民としてのつながりが無くなってしまったから。その時は、さまざまな問題はあれど、日本語をベースに相手に対する配慮や共感、思いやりを共有できたが、今や、交流すればするほど不信感が強まるような状況になっている。また、かつてのいわゆる1965年体制においては、日本による植民地支配が合法か不法かをあいまいにして、いわば双方の『正義』を共存させてきたが、グローバル化の時代となるほどに、それはできなくなった。現代は、ソフトパワーの源としての規範や価値に、共に向き合い、それを共同で「生きた規範」とする必要が生じている。他方で、個々の今ある国民感情を正当化するためだけに、普遍的な価値が利用されるという現象が生じており、対立を煽っている。

    歴史の絡む問題において、日本側は、最終的かつ不可逆的に解決済みだとか、国際法はこうだ、といった国際法の論理を持ち出す。一方、韓国側は、軍事独裁で救済されなかった植民地支配の被害者を今日の人権規範に照らして救うのが世界の潮流だと主張する。お互いに依拠する法的論理と『正義』がずれている。ことなる正義の対立を包摂するような大きな法的論理（規範を現地化すること）が必要である。和解学は、薄れてしまった市民社会のつながりを人工的に再生する取り組みとして対話を促すための知的基盤であり、こうした新しい法的論理の基盤自体を、感情や記憶をそれを支える価値とともに、冷静な議論の対象とすることを可能とさせる学問となろう。パワー・国益・国際法という主権中心の西欧国際関係の論理とは別に、主権者としての国民を構築している感情・記憶・価値の論理を対象化しつつ、互いの壁を越える議論の下地となるであろう。

    現在の日韓関係のこう着状態の打開には、日韓の市民が双方ともに納得でき、国民としての政治観念にも矛盾しないようにする法的論理が必要。双方の一方的な措置、つまり韓国大法院判決に伴う強制執行や日本の対抗措置としての制裁は互いの不信感を高めるだけで、誹謗（ひぼう）中傷を含めた『暴力』を誘発する大変危険な行為。
    国際司法裁判所（ＩＣＪ）への提訴という方法は、今の日韓の法的な論理を競わせるのみではなく、ＩＣＪに高い次元からの仲裁をしてもらうという前提であれば良い。国内の裁判所の出す一般的法的論理は、時代状況に合わせて変わっていくが、国際社会は激しく変化しているのに、法を創設し変えていく機関がない。ＩＣＪがその機能を担い、日韓の国民をともに納得させられるなら提訴も可能。
    他の方法としては、紛争当事国の合意のもとに、植民地支配に伴う被害者救済のための人権委員会のような枠組みを共同で創設することも検討に値する。そこには韓国人被害者のみならず、日本の戦後措置からも漏れた日本人孤児や空襲被害者・在日外国人を含む人権被害者を国家の名誉とか国民の法的論理とは関係のないところで救済できないものか。

    文喜相（ムン・ヒサン）大韓民国国会議長の講演内容の要約は以下の通りです。 ＜ ＞で私が付したタイトル、その下に切り取られた発言の一部が続きます。 全文は、URLをご覧ください。 ＜日本の国民とメディア、そして日本政府の恩を忘れない＞ 金大中(キム・デジュン)大統領は、いつも自分の生命と安全を守ろうと長年にわたって努力してくださった日本の国民とメディア、そして日本政府の恩を忘れないといつも言っておりました。 また、日本が韓国の民主主義の達成において、そして、IMF経済危機から脱するにおいても、大きな支援をしてくださったことに対し、いつも感謝しておりました。 ＜不本意ながらある外信の報道で日本の方々の心を傷つけてしまったことをよく存じ上げております。＞ 去る2月、不本意ながらある外信の報道で日本の方々の心を傷つけてしまったことをよく存じ上げております。そんな訳で、すでに日本の政治家や議会指導者の方々に申し訳ないという意思を表明しております。日本のマスコミにも報じられましたけれども、本日、日本の未来の希望でいらっしゃる大学生の皆さんの前で、もう一度、私の発言により、心が傷ついた方々に申し訳ないということをこの場をお借り致しまして改めてお詫び申し上げたいと思います。 ＜（現下の危機）その深刻さは危険水準です。迅速に解決策を作らなければならないということをもう一度強調いたしたいと存じます＞ 現下の韓日の葛藤がかつての困難とは違い、危ぶまれているのには、理由があります。両国政府間の関係にとどまらず、一般国民の感情にまで入り込んでいる状況であるからであります。その深刻さは危険水準です。迅速に解決策を作らなければならないということをもう一度強調いたしたいと存じます。 まさにこのような時こそ、韓国と日本両国の議会や政治家がクリエーティブな役割を果たさなければならないと思います。議会の役割とは、両国政府間でできることは積極的に支援し、政府間でできないことであれば、それに対するクリエーティブな解決策を模索することであると思います。 ＜韓国国内の立法による「新たな仕組み」と首脳会談の提唱＞ もはや韓日関係を取り戻す「新たな仕組み」を作る立法的な努力は、議会指導者の責務であると思います。こうしたことから私は、韓国の立法的解決策を示したいと思います。韓国の国会にはすでに日帝による強制徴用被害者問題を解決するための様々な方策を盛り込んだ法案が何件か提出されています。私はこうした法律案を分析して取りまとめ、一つの案で提案したいと思います。 法律案に具体的に盛り込まれるべき内容は、第1に、強制徴用被害者問題や慰安婦被害者問題など韓日の間の葛藤を根本的かつ包括的に解決する内容でなければなりません。第2に、韓国大法院の判決を受け、すでに執行力が発生した被害者と、将来的に予想される同じ内容の判決で勝訴した被害者に「慰謝料」が支払われれば、日本企業の賠償責任が「代位返済」されたものとみなされ、賠償を受けた人に対しては民事訴訟法による「裁判上の和解」が成立したものと、みなされ、長い間続いた議論が終結する根拠が盛り込まれなければなりません。第3に、未来志向的な韓日関係に向けて韓日請求権協定などに関する全ての被害者の賠償問題を一定期限を定めて一概に解決する規定を盛り込む必要があります。 当然、関連の審議委員会も設置しなければなりません。財源の確保については、基金を設置するものの、両国の責任ある企業が賠償する1＋1方式を原点から見直す方向が望ましいでしょう。基金の財源は、第1に、両国企業の寄付金でつくるが、責任ある企業だけでなく、その他の企業まで含め自主的に寄付する形であります。第2に、両国国民の民間募金です。第3に、現在残っている「和解・癒し財団」の残高60億ウォンを含めることであります。 最後に、こうした基金を運用する財団に対して、韓国政府が拠出できる根拠条項を作らなければなりません。このように被害当事国である韓国が先駆けて立法を行い、韓日両国が対立している懸案について包括的に協議を行い、譲歩できる名分を与え、和解と協力の糸口がつかめることを期待します。 ＜第2の金大中・小渕宣言、文在寅・安倍宣言を希望＞ 皆さん、外交とは、可能性のアートで、政治は、生き物だと言われています。文在寅大統領の選挙区は釜山です。安倍総理の選挙区は下関です。今も両地域を連絡船が行き来していますが、この船の上で行われる韓日首脳会談を想像してみましょう。南北、米朝首脳会談に匹敵するくらい全世界からの注目を浴びると思います。この首脳会談を通じ、まず第1に、国交正常化の決着を付けた韓日請求権協定と1998年に金大中大統領と小渕首相とが署名した「日韓共同宣言」を尊重し、第2に、日本のホワイトリストからの韓国排除と韓国のGSOMIA終了措置を元に戻し、第3に、両国の懸案問題(強制徴用工問題など)を立法によって根本的に解決する妥結が行われることを期待します。

    I would like to make three brief remarks as my opening remarks, focusing on the past traditions of East Asian studies in Yenching Institute, the challenges facing the world today, and what I consider to be the mission of this conference. First, it goes without saying that the Yenching Institute has been a leader not only in East Asian Studies at Harvard University but also in the United States. I am currently researching Dr. Edwin Reischauer, who served as Director of the Institute in the years prior to his appointment as Ambassador to Japan. Of course, his prewar experiences in Japan as a boy in the Taisho era, his college experience in the U.S., his cryptanalysis in the Navy Department during the war, and his Far Eastern policy advisory work in the State Department are all very interesting as background. But what I consider particularly important is that Reischauer returned to Harvard from the State Department after the Second World War, and while positioning Japanese democracy as a model for Asia, he proposed an American policy toward Asia should accompany the emergence of nationalism in Asia first, before making walls against communism. With an awareness of McCarthyism, Reischauer, along with Fairbank, argued that nationalism was more important than communism and that we must support the democratic nation-building process in Asia through economic cooperation. The Yenching Institute was the mother institution for Harvard's East Asian Studies, which has nurtured a large number of scholars and research centers. This will not only provide us with clues as to why the historical problems between Japan and South Korea will never go away, but will also allow us to explore the origins why the policy of engagement with China has not functioned well.

    The dissolution of Japanese Empire had been unique in these senses that (1) firstly, it was done by the allied powers as a result of the defeat with forced evacuation of its residents to its original territories disregarding economic breakdown of each region, (2) secondly the dissolution was originally planned by the US and UK agreement as a part of innovative allied reparation policy to convert such Japanese properties as left in ex-colonies for the basic infrastructure and industrial facilities of independent nations, ROC and a unified Korea in due course of its independence, (3) thirdly the reparation policies had eventually been transformed into economic corporation programs by Japan after 1947 in proportion with the revival of Japanese economic powers, not only because of cold war but because technology transfer had been difficult to be managed within a few years. How such a unique reparation policy and development have been linked with contemporary history issues? I want to start arguing this point, focusing upon Edwin Reischauer’s role for formulating US inter-mediation of the normalization process between Japan and South Korea, who also advocated regional studies of Asia as a region, focusing upon each national emotion and psychology enframed with historical memories and democratic values, which should be reflected

    In order for democracy to actually function as an system, a huge community of "people" or "nation" as the subject of democracy is indispensable. How has the media, which enables us to imagine an imaginary national community in our minds, shaped the memory shared by the people, and Japan's cultural policy in the postwar period? By analyzing dramas and documentaries on colonial rule and war on television and film, and comparing them with those in Europe and with those in China and Korea, it was suggested that a major turning point occurred in the 1970s, and that colonial rule itself needs to be considered in a different context than in Europe.

    Regarding the war between Japan and the USSR in August 1945, we examined how the battle in Manchuria proceeded. In addition, we analyzed Soviet military strategy in Karafuto. We found that the Kwantung Army let its soldiers die in vain and failed to protect settlers. We also investigated the role of the Manchukuo Imperial Army and the Mongolian military in this war.
    Concerning the Siberian Internment, using Soviet documents, we shed light on female internees and internees charged with political crimes. About repatriation, we clarified measures taken by the Japanese government, including at the Hakodate Regional Repatriation Centre. Furthermore, we examined Soviet treatment of Japanese people in Karafuto, emphasizing the import of those Japanese who remained living in Sakhalin after it became the territory of the Soviet Union.

    (1)Managing the history problem through strengthening of the bilateral alliances no longer works. Reconciliation would be more effectively promoted through easing of tensions and confidence-building measures in the context of multilateral security cooperation. (2) Given the transformative impact of globalization upon civil society, transnational human and material exchanges will not necessarily contribute to mutual understanding of history. Such exchanges require more careful transnational coordination between pro-reconciliation forces against the nationalistic elements. (3) A reappraisal of the ‘German model’ widely accepted in East Asia as the ‘success story’ will mitigate the victimhood nationalisms in Korea and China. (4) We organized history dialogues between university students and the project members, which turned out a great success in terms of promoting trans-generational understanding of history.

    In East Asia, dialogues among nations are frequently interrupted by seemingly insurmountable disputes over history and attempts at historical reconciliation are generally evaluated as a “failure”. In East Asia, the promotion of historical reconciliation presents two specific difficulties. While people in Europe have problematized historical reconciliation as issues of war responsibilities, people in East Asia are more attentive to the issues of colonial responsibilities. Also, people in East Asia experienced the process of democratization and hyper-economic development differently in terms of their chronologies and political implications. As a result, people in East Asia can promote historical reconciliation more effectively by paying more attention to the historical specificities in East Asia in terms of colonialism, democratization, and economic development, as well as by critically reviewing the current theoretical framework of international law.

    In this study, we looked into the documents about normalization of diplomatic relationships between Japan and the ROK. We have also formed a research group, panel discussion, symposium using materials from archives and museums in Japan, the ROK, and the United States with the assistance from the ROK researchers. So, we were able to present certain prospects that these three governments－Japan, the ROK and the United States－have respective responsibilities on the issues concerning the claims and historical recognition discussed in talks on normalization of diplomatic relations between Japan and the ROK, while considering the period after the diplomatic normalization in 1965.

Especially the claim problem had been dealt with two points of views: regional security and economic-political reform of each country.

    The purpose of this project is to clarify the characteristic of the economic development of East Asia in the world history. We carried out the comparative study of East Asia from four viewpoints of "formation of modernistic large-scale industry", "formation and strengthening of a nation-state", "correspondence to the market economy by a peasant folk", and "the joint form of each country and the world economy." The result of research is as follows. The loose economic growth was progressing in contrast with the rapid high economic growth in the first half of the 20th century of the East Asia area.
    Between the loose growth of the first half in the 20th century, and the high growth of the second half, the direct reorganization policy of the industry and resources by the government of each country was implemented powerfully. Such reorganization of East Asia economy was not forced with foreign pressure, but a result of active selection according to the people of each country.

    We have aimed at providing a comprehensive framework to investigate the changing realities of the 21th century world such as the resurgence of China as a superpower and the multi-polarization of the world, and to appreciate them from a historical perspective of civilizations. Through interdisciplinary research, we have explored (1)the relevance and limitations of what we call a "transcivilizational" approach to history to appreciate the fundamental change in human history from the co-existence of ego-centric universalistic civilizations to the establishment of West-centric sovereign states system in the modern era, and (2) the shift in the multi-layered identity of non-European peoples generated in the process of Westernization. By critically examining the prevalent concepts such as "nation,""civilization,""Asia," and "Islam," which tend to be essentialized, we have sought to overcome the widespread ideas of "conflicts" among nations, ethnic (or religious) groups, and civilizations.

    In March and June of 2014, respectively we presented each paper at the annual conference of Association for Asian Studies in Philadelphia and the North American Taiwan Studies Association conference in the university of Wisconsin-Madison.
    Particularly in the later one we joined in the same panel on the basis of the findings of our research projects.
    Through participating in academic occasions like these Dr. Wu had a chance to share his work with other specialists and discuss with them on the findings. Also for me, a continued interchange and international network of research activities with those scholars in Canada and the United States has been established through D. Wu's cordination and Taiwan Studies' network in English. Further academic cooperation on migration issues is highly expected.

    A book has been published under the title of “Reparations and Claims,” and an international symposium was held at Korea University in Seoul. The special relationship between Japan and the United States in Asia was found to be linked with postwar Japanese re-emigration and even with nuclear power issues, while the special relationship strikes at the origin of contemporary history issues. The process of the development of Asia’s history issues was also analyzed in an article included in a book in Iwanami Shoten, Publishers’ Security series.

    This study focused on the cost the allied powers had owed in post-war international security. In this syudy, the central issue was Japanese-Korean reparation ploblem, as well as Japanese responsibility for occupation, recovery and compensation.
    Our study analyzed this theme on the basis of not only bilateral but also world-wide and pluralistic viewpoint. We took up following topics; Firstly, the establishment of new international trade and monetary systems. Secondly, the precedent process of recovering international relationships in postwar Europe (especially, Germany, France & Italy).     The "San Francisco peace regime" formed by the Treaty of Peace with Japan of 1951, and bilateral peace treaties and reparations agreements was the mechanism of having managed the problem of the right of demand for compensation resulting from war and/or colonial rule, and bringing about the stability of the international order of the Asia-Pacific region. The regime formed at the climax period of the Cold War had also contained the claim problem of China or South Korea which had not signed the Treaty of Peace with Japan of 1951.
    But, the comfort-women problem which asks for individual compensation in China or South Korea newly blew off at the first half of the 1990's. The effect was restrictive although the Japanese government which felt uneasy at the stability of the regime carried out Asian Women's Fund as a new history reconciliation policy which complements the regime. The end of the Cold War and the fluctuation of the Liberal Democratic Party rule shook the stability of the regime.

    This project's main issue is to argue the framework for the East Asian regional history around 1970's, by which we can recognize this region as a region. Official Documents have been researched, while big symposiums were held almost every year, which have been formalized as a shuttle academic conference of East Asia by the contemporary Korean Studies center in Tokyo University, Asiatic Research center in Korea university and the Department of International Relations in Tsinghua University, China.
    A set of seven plus 5 volumes of reprinting official documents on Korea- Japan relations in 1960's was published, which was followed by another set of 5 volumes repringting. Through these events 1970's history with governments and civil asociations intertwined came to be argued internationally in East Asian framework with transnational academic networks constructed and appealed to general.

    共同研究を通じて、学界全体への新しい問題提起となるような論文を発表し、それを支える資料集を刊行することができた。李東俊氏は朝鮮銀行についての論文をアメリカと韓国・日本での調査をもとに発表したのみならず、李氏のおかげで日韓交渉に関連する韓国側の資料を全面的に日本語訳して資料集に収録することができた。実際、1951年から65年まで14年間にわたって展開された日韓交渉に関連する政府文書を集め、第1期とし9巻にわたって刊行した。
    脱植民地化の問題が冷戦下でどのように変容していったのかという問題意識のもとで、二人の共同報告をアジア政経学会において行い、京都大学の堀和生先生や問題意識を同じくする若手研究者のコメントをいただいた[歴史としての日韓国交正常化分科会、アジア政経学会(京都大学、座長堀和生)2010年6月12日]。
    2年間の共同研究を推進したことにより、韓国の国民大学、及び高麗大学との学術交流が飛躍的に進み、若手研究者相互のネットワークが進化した。その推進力として、李東俊氏の来日と滞在は、大いに貢献をしてくれた。こうした共同研究の成果として、李氏は韓国高麗大学にHK研究教授として着任された。
    総じて、李氏が滞在していたおかげで、ともにじっくりと枠組みを模索しながら論文を執筆することができ、『日韓国交正常化問題資料』の発行をも軌道に乗せることができた。資料実証的な研究成果を土台に、東アジアという地域としての冷戦史を、日韓米という国際的な人間関係のもとで、かつ、ゆるやかではあるがより共通する問題意識や方法論によって推進するための枠組みを芽吹かせることができたと感じる。

    The members conducted interviews with the ex-colonial soldiers and the residents as well as the detainees who experienced WWII in Burma (partially India) and Philippines. Those interviewees were not only the Burmese and the Philippines but also the Anglo-Burmese, the Kenyans and the Taiwan Chinese. The discourses of their memories were recorded directly and were checked up with the documented records (such as administrative records) as possible as we could. The members exchanged their outcomes in close cooperation and constructed the base for future publications of their academic results.

    This research intends to also obtain cooperation of a South Korean researcher and to perform reference collection in a comprehensive viewpoint focusing on the South Korean researcher, a Japanese political diplomacy (史) researcher, and an international-relations researcher, and it is.
    Although document data are natural in that case, the fundamental data about relations between Japan and South Korea are collected ming the oral method currently established methodically recent years at last.
    Since the research situation so far also needed to be grasped in order to develop future research, the focus was applied and studied to two points of performing check of the research situation in both Japan and South Korea, collected interviews, arrangement of the research task based on collection data, etc. by the researcher of Japan and South Korea.
    When the South Korea side researcher also mixed and argued about the contents, collected document data, etc., the following points became clear.
    Although it is having become clear from testimony of the Saburo Tsukamoto former Democratic Socialist Party Chairman (there was exchange with a South Korean political party) who carried out by President Kim and another research in the first place etc.
    In South Korea under a military regime, it is that not only the government side but the opposition politician who took the lead in a democracy movement was working against the background of the close relation between the U.S. or Japan.
    Although contents second concrete about the activity of the political party which is the center of a democracy movement until now were seldom clarified, an intraparty situation, the actual condition of an election campaign, etc. are that the whole surface appears in testimony of President Kanemoto, the tension former vice chairperson, etc.
    It is that third the state of presidential leadership and the whole surface of policy decision in the basis of a presidential system were clarified.
    The above point is clarified by this research, and I think that it develops into future research on the basis of this.

    戦後日本とアジア諸国との外交関係樹立にあたっては、敗戦後の日本人引揚に伴い発生した現地所在の元日本人所有私有財産について、その清算代金支払い要求が国内に定住を始めた引揚者から提出され、外交交渉にも反映されていた。 その引揚者の要求は、保守政治家・元官僚有力者の支援を受けて進められ、在外私有財産を日本政府もしくは相手国政府が補償せよとするものであった。引揚者にとって「外地」で失った土地家屋は、自らと父祖の移住と開拓を象徴した。その補償問題は戦後日本社会における植民、外地への移住と帰還の社会的記憶と意味を左右し、引揚者の「政治的性格」を決する問題であった。つまり植民地支配の性格を社会的に決する問題であったといえる。運動過程でも、一方で、引揚者が帝国主義の「走狗」と呼ばれることに耐えられないという反発があり、他方で、賠償責任を引揚者にのみ負わせ戦争被害のみを訴えるばかりの日本社会全体への違和感、そしてアジア諸国への反省が存在した。 日本政府は、講和準備段階では、在外私有財産を賠償総額全体を左右する重要テーマとみなし、国際法上の公式領土所在のそれを、満洲事変以後の非合法領土・占領地所在のそれと区別して交渉せんとした。また、講和以後は、国内の引揚者からの在外私有財産補償責任を回避するべく、日韓交渉に代表される「経済協力」方式による国交正常化を行った。それこそ、正式な賠償や補償という言葉...

    本研究を通じて、帝国法制の二大特徴が明らかとなった。 第一の特徴は、東アジア国際秩序の政治的サブシステムとしての日本帝国の法的性格である。これは、日本自身の帝国化が台湾領有とほぼ時を同じくする条約改正によって導かれたことに端を発する。西欧列強が東アジアに形成した「不平等条約」を支えていたところの属人的に本国の法制が居留地に滞在する西洋人に及ぶとする治外法権制度を逆手にとり、台湾全土に属人的な民事・刑事全般の基本法制度を敷いたことが、帝国法制の基本構造を決定することになった。つまり、現地での貿易を可能ならしめる生命と財産の保障を、この種の法制を現地に敷くことで責任を持って実行できるとしたことが、イギリス等に台湾での治外法権廃止を認めさせる契機となったのである。こうした列強の意向を常に考慮しながら植民地化を進めるという傾向は、朝鮮の保護国化と併合においても一貫していた。帝国法制の基本構造は、こうして導入された属人的な法制度を本土法の帝国大の属地的延長施行によって徐々に私法の家族法分野にのみ限定していくベクトルと、本土とは異なる委任立法の枠組みによって作られた「外地」でのみ均一な属地的法制によって属人法を解消しようとするベクトルとのせめぎ合いと理解することができる。 第二の特徴は、古典的な公法と私法という区分がゆらぎ、行政法、経済法、社会法という公法と私法の二つの性格を混在化させた...

    グローバルヒストリーの見地から、日露戦争後の韓国併合が帝国形成の一環として行われたこと、それらがその後の日本帝国の運命を規定していくことを解説し、「植民地」とは何かを考えます。日本は「アジアで唯一の近代化」を成し遂げました。しかしそうした「輝かしい」近代の裏側が、いま、韓国の民主化以後、本格的に問われています。「加害責任」「植民地責任」といわれる問題です。こうした問題を、近代の明と暗という二つの側面のからまり合いを構造的に把握することによって、つまり、より高い次元の歴史観の構築によって「堂々」と対処し、「自虐的」という批判を浴びることなく、子供達のモラルを育むに足る歴史の基盤構築が必要と考えます。
    国民史というものは、どんな国でも「素晴らし」く、国民としての感情を育むために作られるものです。しかし、お互いの影の部分を各国が自覚することでこそ、グローバルな信頼と国民感情相互の結びつきが生まれます。
    そもそも「国民」という枠組みもまた歴史の産物です。複雑に利害が衝突する国際政治が、社会に及ぼした衝撃から近代的「国民」が形成されました。こうした「国民意識」が日常生活へ浸透していく過程を歴史学的に把握しつつ、「日本人」や「韓国人」「中国人」という国民意識そのものが、いかに近代において誕生し編成されていったのかを、日露戦争後から韓国併合に至る歴史から、解き明かしていきたいと思います。
    いま私たち日本人は「歴史認識」をめぐる激しい摩擦に直面しています。こうした強い感情を伴う集合意識を、自己から離して対象化するための基礎を作っていけたらと思います。

    　近代日本の植民地支配の起源と展開について、国際関係的要因を中心として分析した。従来の研究では、帝国的膨張の起源と展開は、中心にある日本の社会構造的矛盾の発現としてのみ理解されていた。つまり、帝国の中心にある何らかの要因に従い、沖縄と北海道→台湾→南樺太→朝鮮→満洲→大東亜という順で同心円的膨張を行ったと位置付けられてきた。しかし、分析の結果、日本帝国の起源は、居留地制度という西欧国際システムと東アジア世界との境界面に作られた制度、特にその根本原理となっていた治外法権という慣行と深く結びついており、それを巧みに利用して帝国の内部の法秩序を作り上げていることがわかった。帝国の膨張の契機、そして帝国内政の構造も、少なくとも日本帝国の場合、東アジアの国際秩序、特に治外法権制度を抜きにしては、理解できない。　第二に、帝国の統治の特徴である「同化政策」を法の下の平等と文化的同一化という二つの政策を組み合わせたものとして理解する従来の分析枠組みに対し問題点を指摘し、新たな枠組みを、文化と法制との関係を焦点に提示した。問題は、「個人」が存在していない旧慣世界の共同体社会から、日本人としての意識を有する「個人」を析出させるのが、同化政策の一般的目的であった点に着目すべきという点にあった。こここから、法の下の平等という観念を公法私法を区別しない一般的法制全体に投影してはならず、法制の構造は前述した国際関係的要因をも交えつつ、公法と私法を分けて、しかも法域ごとに論じていかねばならないことを主張した。

  • 植民地における領事裁判権制度の廃止と日本帝国の法的形成及び展開

    　満州国国籍法の制定は、民族自決に立脚した分離独立という建前を維持するため、その前提となる「住民」を定義するために必要とされていた。しかし在満日本人が日本国籍離脱を嫌っていたため、二重国籍を法制化せざるを得ない状況が生まれていた。しかしこの二重国籍状態の法制化は、在満日本人をして権利に関しては満州国民と同じ完全な私権公権を享有させる反面、義務に関しては治外法権ゆえに免税特権を持ち警察権や司法権の外に置き、一切の国家的義務から除外することとなり、満州国の独立とはなはだ矛盾した事態を生じさせるものであった。　つまり、満州国の独立のためには、自決すべき住民を定義するために国籍法が必要である反面、その制定は独立の虚構を国際社会に名実ともに暴露することとなるというジレンマ状態が存在していた。これが満州国に対して日本との間で治外法権廃止に関する条約を締結するという国家構造の転換を行わざるを得なかった構造的な原因であった。　また、奉天とハルピンにはイギリス領事館があり、その資料が重要であることが判明した為、ロンドンでの調査を急遽行った結果、日満間の治外法権廃止には国際関係的な要因も働いていたことがわかった。一九三五年前後、日本の外務省ではイギリスの満州国承認の可能性が真剣に検討されており、日本が治外法権を撤廃する以前にイギリスが満州国を承認すると満州国はイギリス人の治外法権をみとめざるを得なくなってしまうこととなるため、その以前の段階で日満間の治外法権廃止を早急に進める必要に迫られていたことが判明した。　つまり、満州国の国家構造の根本的転換を意図した治外法権の廃止は、国民を定義するための国籍法制定の必要という国内的事情と、イギリスによる満州国承認の可能性という国際的要因とを背景として行われたものであった。しかし、そうした既存の国際秩序を前提とした満州国育成は、最終的には行き詰まったことが、国籍法の制定が最後まで行われなかったことからわかる。満州国の国籍問題は、日中戦争後に、「東亜新秩序」を掲げざるを得なくなる構造的な理由までも示唆しているのである。
